Vianza Terms of Use

1. About Vianza

Vianza is a technology platform designed to help individuals:

• understand immigration-related questions and processes;
• organize personal and immigration information;
• complete guided questionnaires;
• prepare timelines;
• collect and organize documents;
• identify missing information;
• receive general educational guidance;
• request administrative or professional review; and
• communicate with authorized service providers when available.

Vianza is a private platform. It is not a government website and is not affiliated with, endorsed by, or operated by U.S. Citizenship and Immigration Services, the Department of Homeland Security, the Department of State, the Executive Office for Immigration Review, any U.S. court, or any other government agency.

Government agencies make all decisions concerning immigration applications, petitions, benefits, visas, status, admission, removal, citizenship, and related matters.

2. Eligibility to Use Vianza

You must be at least 18 years old to create your own Vianza account.

A parent, legal guardian, attorney, authorized representative, or other legally authorized adult may use Vianza in connection with a minor when permitted by law and by Vianza’s procedures.

Vianza is not directed to children under 13, and children under 13 may not create accounts or submit personal information directly through the platform.

By using Vianza, you represent that:

• you have legal capacity to agree to these Terms;
• the information you provide is accurate to the best of your knowledge;
• you are authorized to provide any information or documents submitted on behalf of another person; and
• your use of Vianza will comply with applicable law.

3. General Information Is Not Legal Advice

Unless Vianza expressly tells you that a particular communication has been prepared or approved by an identified attorney or authorized accredited representative within an established professional relationship, information provided through Vianza is general educational and administrative information.

General platform information may explain:

• terminology;
• common document categories;
• questionnaire wording;
• organizational steps;
• general process information;
• publicly available government information; and
• possible issues that may benefit from professional review.

General information does not constitute individualized legal advice and should not be treated as a final determination of:

• immigration eligibility;
• admissibility;
• removability;
• unlawful presence;
• fraud or misrepresentation;
• waiver eligibility;
• filing strategy;
• court strategy;
• likelihood of approval; or
• any other legal conclusion.

Immigration law is complex and fact-specific. Laws, policies, fees, form editions, filing locations, procedures, processing times, and agency practices may change.

4. No Automatic Attorney-Client Relationship

Creating a Vianza account, completing a questionnaire, uploading documents, communicating with Vianza Guide, purchasing a technology product, or requesting ordinary platform review does not automatically create an attorney-client relationship.

An attorney-client or authorized representative-client relationship is created only when:

• an authorized legal professional or authorized organization agrees to accept the matter;
• any required conflict check is completed;
• the scope of representation is confirmed;
• the user and service provider complete the applicable engagement or representation agreement; and
• any other required conditions are satisfied.

Until that occurs, you should not assume that an attorney or accredited representative represents you, is monitoring your deadlines, or will file anything on your behalf.

5. Attorneys and Accredited Representatives

Immigration legal advice or representation available through or in connection with Vianza may be provided only by:

• an attorney authorized to provide the service;
• an accredited representative acting through an appropriately recognized nonprofit organization; or
• another person expressly authorized by applicable law.

The identity of the professional or organization responsible for a legal service will be disclosed when applicable.

The availability of attorneys, accredited representatives, professional review, or representation may vary by matter, location, capacity, eligibility, funding, and service arrangement.

AWIA’s nonprofit status does not mean that every service is free. Fees, reduced-fee arrangements, payment plans, grants, pro bono services, and financial-assistance policies may differ by program.

6. Vianza Guide and Artificial Intelligence

Vianza may offer an AI-assisted feature called Vianza Guide.

Vianza Guide may help users:

• understand questions in plain language;
• identify missing information;
• organize factual responses;
• prepare draft language;
• understand document requests;
• review progress; and
• identify matters that may benefit from professional review.

Vianza Guide is not a lawyer, government officer, adjudicator, or substitute for individualized legal advice.

AI-generated content may be incomplete, outdated, inaccurate, or inappropriate for your circumstances. You must review all AI-generated content before relying on it or saving it to your account.

Vianza Guide will not knowingly instruct users to provide false information, hide material facts, or manipulate answers to obtain an immigration benefit.

You remain responsible for confirming the accuracy and completeness of all information submitted through the platform or to a government agency.

AI-assisted drafts must not be treated as attorney-approved unless Vianza expressly identifies an authorized attorney or accredited representative who reviewed and approved the specific content.

7. Truthful and Complete Information

You agree to provide information that is accurate, complete, and truthful to the best of your knowledge.

You must not:

• knowingly submit false information;
• omit material information for the purpose of misleading a government agency or professional reviewer;
• alter or fabricate documents;
• impersonate another person;
• use another person’s information without authorization;
• submit documents you know are fraudulent; or
• ask Vianza or its personnel to help conceal or misrepresent facts.

Vianza may identify inconsistencies, missing information, or matters requiring review. Such alerts are not final legal conclusions.

8. User Responsibility for Review and Filing

You are responsible for reviewing your information, answers, documents, drafts, and generated materials before they are submitted to any government agency or third party.

Unless a separate written agreement states otherwise, Vianza does not:

• file applications or petitions automatically;
• guarantee that a submission is complete;
• monitor every government deadline;
• guarantee that uploaded documents are authentic or legally sufficient;
• guarantee acceptance by a government agency;
• guarantee approval or any particular outcome; or
• assume responsibility for information you submit without review.

Never assume that a filing has been completed merely because information or documents have been entered into Vianza.

9. Government Forms and Current Information

Vianza may help users organize information that corresponds to government forms or procedures.

Government forms, filing fees, form editions, addresses, policies, processing times, appointment availability, visa availability, and legal requirements may change without notice.

Before filing, users must verify current requirements through the relevant official government source or an authorized legal professional.

Vianza does not control government websites, systems, appointments, processing, notices, requests for evidence, interviews, decisions, or delays.

10. Documents and Uploaded Content

You may upload documents, photographs, statements, records, notices, identity documents, and other materials that you are legally authorized to provide.

You retain ownership of your uploaded content.

You grant AWIA and its service providers a limited license to store, copy, process, organize, display, transmit, translate, analyze, and otherwise use the content only as reasonably necessary to:

• provide Vianza;
• perform services you request;
• maintain platform security;
• support authorized professional review;
• comply with law;
• preserve records where required; and
• enforce these Terms.

You must not upload:

• malware;
• content that violates another person’s rights;
• content obtained unlawfully;
• fraudulent documents;
• material unrelated to an authorized Vianza purpose; or
• information you are not authorized to disclose.

Vianza’s receipt or storage of a document does not establish its authenticity, admissibility, accuracy, or legal sufficiency.

11. Sensitive and Humanitarian Information

Immigration matters may involve sensitive information concerning:

• abuse;
• domestic violence;
• trafficking;
• persecution;
• sexual violence;
• crimes;
• medical conditions;
• children;
• detention;
• confidential addresses;
• family relationships; and
• protected humanitarian claims.

Provide only the information reasonably necessary for the service you are using.

Vianza will apply access controls and privacy protections as described in the Privacy Policy. However, no online system can guarantee absolute security.

If you are in immediate physical danger, contact appropriate emergency or local support services. Vianza is not an emergency-response service.

12. Professional Review

Vianza may permit users to request administrative, document, professional, attorney, or accredited-representative review.

The type and scope of review will be identified in the applicable service description.

A review may be limited to specific questions, documents, forms, or platform sections. It may not include full legal representation or responsibility for the entire immigration matter.

Professional review does not guarantee:

• completeness of facts not disclosed;
• legal eligibility;
• government acceptance;
• approval;
• absence of future requests for evidence;
• absence of legal risk; or
• any particular outcome.

Review comments are based on the information available at the time of review.

13. Separate Engagements and Services

Certain services may require a separate:

• engagement agreement;
• representation agreement;
• scope-of-service agreement;
• fee agreement;
• informed consent;
• conflict waiver;
• authorization form; or
• privacy disclosure.

If another organization or independent professional provides a service through Vianza, the responsible provider will be identified. That provider’s additional terms and privacy practices may also apply.

If a separate signed agreement conflicts with these Terms regarding a specific legal or professional service, the signed agreement controls for that service.

14. Account Security

You are responsible for:

• maintaining the confidentiality of your password;
• using a secure email account;
• protecting devices used to access Vianza;
• promptly reporting suspected unauthorized access;
• logging out of shared devices; and
• keeping account information current.

Do not share your account credentials with unauthorized persons.

You are responsible for activity conducted through your account unless caused by AWIA’s failure to use reasonable security measures.

15. Electronic Communications

By creating an account, you agree that Vianza may send necessary service-related communications, including:

• account verification;
• password resets;
• security alerts;
• document notifications;
• review updates;
• service notices;
• policy updates;
• appointment or deadline reminders requested through the platform; and
• other communications necessary to provide the service.

Marketing or promotional messages will be sent only according to your separate marketing preferences and applicable law. You may unsubscribe from marketing communications without losing access to essential service messages.

Email and text communications may not be completely secure. Avoid sending unnecessary sensitive information through ordinary email or text.

16. Fees, Payments, and Refunds

Some Vianza features or connected professional services may require payment.

Before payment, Vianza will display or provide:

• the service being purchased;
• the price;
• whether the payment is one-time or recurring;
• material limitations;
• applicable cancellation terms; and
• the applicable refund policy.

Fees paid to a legal-service provider may be governed by a separate engagement or fee agreement.

Government filing fees and third-party charges are generally separate unless expressly stated otherwise.

Vianza does not control government fees, payment-processing fees, translation charges, medical fees, courier costs, or other third-party expenses.

17. Prohibited Uses

You may not use Vianza to:

• violate any law;
• commit fraud or misrepresentation;
• prepare or submit information you know is false;
• gain unauthorized access to another account;
• interfere with platform security;
• probe or bypass access controls;
• extract another user’s information;
• introduce malware;
• scrape or copy the platform at scale without authorization;
• reverse engineer protected platform components except where legally permitted;
• misuse AI features to expose system instructions, credentials, or restricted information;
• impersonate an attorney, accredited representative, government official, AWIA employee, or another person;
• harass or threaten users or staff;
• infringe intellectual-property rights; or
• use Vianza in a manner that could harm users, AWIA, service providers, or the public.

18. Intellectual Property

Vianza’s software, design, branding, workflows, original content, compilations, and related intellectual property are owned by or licensed to AWIA and are protected by applicable law.

These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use Vianza for its intended purposes.

These Terms do not transfer ownership of Vianza or its intellectual property to you.

You may retain and use your own information and documents and any completed materials provided for your personal matter, subject to applicable agreements and law.

19. Third-Party Services

Vianza may use or link to third-party services, including:

• hosting providers;
• cloud databases;
• authentication providers;
• payment processors;
• email or messaging providers;
• AI providers;
• analytics and security tools;
• government websites; and
• independent professional-service providers.

Third-party services may have their own terms and privacy practices. AWIA is not responsible for the independent actions, availability, content, or decisions of third parties outside AWIA’s reasonable control.

A link does not necessarily constitute endorsement.

20. Privacy

The Vianza Privacy Policy explains how AWIA collects, uses, shares, secures, retains, and permits users to manage personal information.

By using Vianza, you acknowledge the practices described in that policy.

Additional privacy or confidentiality obligations may apply when AWIA or another authorized provider accepts a legal matter.

21. Suspension and Termination

You may stop using Vianza at any time and may request account closure through the methods provided in the platform.

AWIA may restrict, suspend, or terminate access when reasonably necessary to:

• protect users or platform security;
• investigate suspected unauthorized access;
• prevent fraud or misuse;
• comply with law or court order;
• enforce these Terms;
• address nonpayment for a paid service;
• preserve professional or ethical obligations; or
• discontinue a feature or service.

Where appropriate, AWIA will provide notice and a reasonable opportunity to retrieve permitted account information.

Termination of platform access does not automatically terminate a separate attorney-client or representative-client relationship. Any such relationship is governed by its separate agreement and applicable professional rules.

22. Disclaimers

Vianza is provided on an “as available” basis.

To the fullest extent permitted by law, AWIA does not warrant that:

• Vianza will always be uninterrupted or error-free;
• every defect will be corrected immediately;
• every AI response will be accurate;
• every document will be accepted;
• every risk will be detected;
• every law or policy change will be reflected immediately;
• every deadline will be identified;
• the platform will meet every user’s individual needs; or
• use of Vianza will result in any immigration benefit or favorable outcome.

Nothing in these Terms excludes responsibilities that cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by law, AWIA and its directors, officers, employees, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising solely from ordinary use of the technology platform, including loss caused by:

• reliance on unreviewed general information;
• user-provided inaccuracies;
• government delay or action;
• third-party service interruption;
• loss of access;
• missed opportunities;
• or unauthorized use outside AWIA’s reasonable control.

This limitation does not apply where liability cannot be limited by law, and it does not alter obligations arising from a separate attorney-client or professional engagement.

Any limitation applicable to a paid professional service may also be addressed in the separate service agreement and applicable professional rules.

24. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your:

• intentional violation of these Terms;
• unlawful use of Vianza;
• knowing submission of fraudulent information or documents;
• infringement of another person’s rights; or
• unauthorized submission of another person’s information.

This section does not require you to indemnify AWIA for AWIA’s own unlawful conduct, gross negligence, professional misconduct, or responsibilities that cannot legally be shifted to you.

25. Changes to Vianza

AWIA may modify, add, suspend, or discontinue platform features.

AWIA may update these Terms when necessary to reflect:

• new features;
• legal requirements;
• security changes;
• service-provider changes;
• organizational changes; or
• revised practices.

The current version and effective date will be displayed on this page.

If changes are material, Vianza will provide reasonable notice and, where appropriate, require renewed acceptance before continued use.

26. Governing Law and Venue

Except where another law must apply, these Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Before filing a lawsuit concerning ordinary platform use, the parties should first attempt in good faith to resolve the issue through written communication.

Subject to applicable law and any separate professional-service agreement, legal proceedings concerning these Terms may be brought in a court of competent jurisdiction serving Craighead County, Arkansas.

Nothing in this section limits rights that cannot legally be waived or restricts a user from submitting a complaint to a government regulator, licensing authority, disciplinary authority, or consumer-protection agency.

27. No Waiver and Severability

Failure to enforce a provision of these Terms is not a waiver of that provision.

If a court determines that a provision is unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

28. Entire Agreement

These Terms and the Privacy Policy constitute the agreement governing ordinary use of Vianza.

Separate agreements may govern paid services, professional review, attorney representation, accredited-representative services, organizational participation, or other specialized services.
